Solicitud de aclaración de la Sentencia SU.005/18.
La apoderada judicial de las administradoras de Fondos de Pensiones Colfondos S.A.; Old Mutual S.A., Porvenir S.A. y Protección S.A. adujo que, a pesar de que la sentencia trató casos exclusivamente de pensiones, las reglas de unificación se referían a afiliados al Sistema de Seguridad Social en Pensiones, sin identificar el régimen.
Consideró entonces que no existía claridad acerca de la exclusión Régimen de Ahorro Individual con Solidaridad (RAIS) en la aplicación de dichas reglas.
La Corte considera que ninguna de las Administradoras de Fondos de Pensiones que presentaron la petición de aclaración acredita legitimación en la causa para solicitar la misma y, por eso, la Sala Plena decide RECHAZARLA por improcedente.
